Your JUDICIARY COMMITTEE, to whom has been referred
HOUSE JUDICIARY COMMITTEE SUBSTITUTE FOR
HOUSE BILL 99
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 5, line 16, after "a", strike the remainder of the line and strike lines 17 through 24 and insert in lieu thereof:
"single, indivisible injury to a patient caused by the acts or omissions of one or more health care providers whose negligence combined to cause that injury, regardless of the number of health care providers whose acts or omissions contributed to that injury or the temporal sequence of those acts or omissions; provided that when a health care provider's negligence causes a distinct original injury to a patient, and a separate health care provider's negligence causes a second, causally distinct injury or a causally distinct enhancement of the original injury, each causally distinct injury or enhancement of an original injury constitutes a separate occurrence;".
2. On page 6, line 16, remove the brackets and the line
through "and".
3. On page 6, line 18, after "insurance", strike the remainder
of the line, strike lines 19 through 23 and strike line 24 up to the
period.
4. On page 16, lines 3 and 4, strike "operated by a New Mexico resident or domestic corporation".
